4. How We Share Information
4.1 With Recruiters and Employers
When candidates apply for positions through our platform, their application data (including resumes and intake form responses) is shared with the recruiter or employer associated with that job posting. Once shared, that recruiter or employer becomes the controller of that candidate data within their systems.
4.2 With Service Providers
We work with trusted third-party service providers who assist us in operating our Services:
- Analytics Providers: To help us understand usage patterns and improve our Services.
- Email and Communication Services: To send transactional emails and notifications.
- AI and Machine Learning Providers: To power our resume analysis and candidate matching features. Resume text and job descriptions may be processed by these providers to deliver our core Services.
Our service providers are contractually obligated to use your information only for the purposes of providing services to us and to maintain appropriate security measures.
4.3 Legal and Compliance
We may disclose information when required by law, legal process, or government request, or when we believe disclosure is necessary to protect our rights, safety, or property, or that of our users or the public.
4.4 Business Transfers
If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a different privacy policy.
5. We Do Not Sell or Share Your Personal Information
AI Soup Technologies does not sell your personal information to third parties. We do not share your personal information for cross-context behavioral advertising as defined under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).
We use personal information solely to provide and improve our Services, for internal analytics, and as otherwise described in this Privacy Policy. We have not sold or shared personal information in the preceding 12 months and have no plans to do so.
6. Data Retention
We retain personal information for as long as necessary to provide our Services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of data and our legitimate business needs.
When personal information is no longer needed, we securely delete or anonymize it. Aggregated or de-identified data that cannot reasonably be used to identify you may be retained indefinitely for analytics and product improvement purposes.
7. Security
We implement appropriate technical and organizational security measures to protect personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
8. California Privacy Rights (CCPA/CPRA)
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):
- Right to Know: Request information about the categories and specific pieces of personal information we have collected about you, the sources of that information, our purposes for collecting it, and the categories of third parties with whom we share it.
- Right to Delete: Request deletion of personal information we have collected from you, subject to certain legal exceptions.
- Right to Correct: Request correction of inaccurate personal information.
- Right to Opt-Out of Sale/Sharing: Opt out of the sale or sharing of your personal information. As stated above, we do not sell or share your personal information.
- Right to Limit Use of Sensitive Personal Information: Where applicable, limit our use of sensitive personal information to purposes necessary to provide the Services.
- Right to Non-Discrimination: You will not be discriminated against for exercising any of these rights.
Authorized Agents: You may designate an authorized agent to make requests on your behalf. We may require verification of the agent's authority.
Verification and Response: We will verify your identity before processing requests and respond within 45 days, with a possible extension of an additional 45 days if necessary (with notice to you).
9. Deletion Requests and Data Ownership
We handle personally identifiable information (PII) responsibly and will delete your data upon request, consistent with California privacy regulations. Please note the following important distinctions:
For Candidates
You may request deletion of your personal information from our systems (including your account and any data you have directly submitted to us) by contacting us at legal@hrcricket.com.
Important: When you apply for a job through our platform, your resume and application data are shared with and become controlled by the recruiter or employer associated with that job posting. Resumes and application data submitted to a recruiter belong to that recruiter. To request deletion from a recruiter's systems, you must contact the recruiter directly, or we require an explicit deletion request from the recruiter—a candidate request alone is not sufficient to delete data from a recruiter's account.
For Recruiters
As a recruiter, you control candidate data within your account. You may delete candidate data at any time. If a candidate requests deletion of their data, you are responsible for complying with applicable data protection laws regarding data you control. To request deletion of your own recruiter account and associated data, contact us at legal@hrcricket.com.
10. Children's Privacy
Our Services are not intended for individuals under 18 years of age. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete that information promptly.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make material changes, we will notify you by updating the "Last updated" date at the top of this policy and, where appropriate, provide additional notice (such as via email or through our Services).
Your continued use of our Services after any changes to this Privacy Policy constitutes your acceptance of the updated policy.
